1. Scope of application
This limited warranty applies to energy storage products provided by VERYPOWER, provided to the original end customers through authorized means.
2. Limited Warranty
2.1 The limited warranty shall commence on the first day three (3) months after the production date of the product (refer to Appendix 7.1 of Article 7 of this limited warranty for the production date), or from the date on which product ownership is transferred from VERYPOWER or VERYPOWER authorized service partner ("VERYPOWER Partner") to the original end user, whichever is earlier. If the buyer calculates the warranty period starting from the date when the ownership of the product is transferred from VERYPOWER or VERYPOWER partners to the original end user, the warranty period starting from the date of the first application for warranty service for the same batch of shipped equipment shall be calculated from the date of the first application for warranty service.
2.2 The product is free from defects in materials or workmanship, and VERYPOWER guarantees a limited product warranty for a period of five (5) years from the date of warranty, except for the following exclusions and limitations.
2.3 Limited Performance Guarantee
VERYPOWER guarantees that this product will (i) retain eighty percent (80%) of its usable capacity for a period of five (5) years from the warranty start date; Or (ii) the minimum number of cycles that the product reaches according to the parameters provided by VERYPOWER, whichever comes first.
For this limited warranty, the remaining available capacity testing method shall be measured and calculated in accordance with Article 7 of this limited warranty, Appendix 7.2.
2.4 Warranty Limitations
The limited warranties in clauses 2.2 and 2.3 must be read in conjunction with the disclaimers and limitations set forth below.
3. Disclaimer and Limitation
3.1 Disclaimer
3.1.1 To the extent permitted by law, the warranties in this limited warranty are the only express warranties given to this product. VERYPOWER disclaims all statutory and implied warranties, including but not limited to any warranties of merchantability, fitness for a specific purpose, or non infringement. To the extent permitted by law, if the warranty cannot be denied, VERYPOWER will limit the warranty period and remedies to the duration of this limited warranty. VERYPOWER may choose the repair or replacement services described below.
3.1.2 The seller of this product or any other person has no right to represent VERYPOWER to make any warranty outside of this document, or to extend the warranty period beyond the period specified above.
3.1.3 VERYPOWER does not guarantee customer data stored in its products or related to the products in any other form. Customers are responsible for backing up the relevant data to prevent loss.
3.1.4 Product warranty is governed by local laws and cannot be excluded according to local laws. If any provision of this guarantee is declared invalid or unenforceable by any court or administrative agency, such provision shall be deemed modified to achieve the same economic effect as the original provision deleted from this guarantee as much as possible, and the remaining provisions of this guarantee shall continue to be fully effective.
3.2 Limitation of Liability
In addition to this warranty and to the maximum extent permitted by law, in any event, VERYPOWER and its partners shall bear any consequences, incidental, special or punitive damages (including but not limited to loss of profits, damage to goodwill or commercial reputation, or delay damages) arising from the installation, use, performance or non performance of the product, or any defect or breach of warranty, whether based on contract, warranty, negligence strict liability or for any other reason, VERYPOWER's total liability, if any, shall not exceed the purchase price paid by the original buyer for the product in terms of damage or otherwise.
3.3 Warranty Limitations
The limited warranty in clauses 2.2 and 2.3 does not apply to any defect or deterioration caused by:
3.3.1 The product is not properly installed, maintained or operated according to the operation manual.
3.3.2 The product moves or shakes after installation, or the ambient temperature exceeds the range indicated by the parameters.
3.3.3 The original buyer fails to notify VERYPOWER or its partners within 14 natural days after discovering the defect or fault.
3.3.4 The product is not installed within one (1) month from the warranty start date.
3.3.5 Use non-VERYPOWER original accessories, incompatible with third-party software or hardware.
3.3.6 Products that have been disassembled, repaired, or modified without the authorization of VERYPOWER or its partners.
3.3.7 Force majeure events (such as natural disasters, floods, fires, earthquakes, lightning or other abnormal environmental conditions such as energy supply interruptions; social issues such as turmoil, wars, strikes, government regulations, etc.).
3.3.8 Obvious damage to the product during transportation.
3.3.9 Change the laws, regulations or directives of the country or region.
3.3.10 Damage to the battery cells caused by negligence that causes the energy storage to fail to charge for a long time.
3.4 Warranty Exclusions
The limited warranties in clauses 2.2 and 2.3 do not apply.
3.4.1 If the original purchaser has not allowed VERYPOWER or its partners to access the performance data of the product via the Internet after reporting a warranty claim or manipulating these data;
3.4.2 wear-and-tear on the appearance of the product (including but not limited to any scratches, stains, mechanical wear, rust or mold).
3.4.3 Property damage or personal injury caused by any defect if the state of scientific and technical knowledge at the time the product was sold to the original purchaser is not sufficient to detect the defect, or a product defect arises as a result of technological updates or updates to national or regional laws or regulations.
3.4.4 If the product invoice and the information set out in clause 5 below are not provided at the time of warranty claim.
3.4.5 If the serial number on the product can no longer be identified or has been modified.
3.4.6 Equipment auxiliary materials, tools, structural parts, etc.
3.4.7 The physical damage to the surface of the equipment does not affect the use of the equipment.
3.4.8 Equipment authorized only for experimentation, testing, training or demonstration.

4. Liability
4.1 Subject to the above exclusions and limitations, if the product fails to comply with the limited warranty in clause 2.2 or 2.3, VERYPOWER will repair or replace the non-conforming product or its parts within the warranty period, free of charge (or provide a partial refund).
4.2 Whether to repair or replace the product will be at the sole discretion of VERYPOWER.
4.3 The product, or any part it replaces, will have the same performance and reliability as the original product. If production of a product of the type concerned or any part thereof has been discontinued, withdrawn from the market, or otherwise rendered unserviceable, VERYPOWER may substitute a similar product or part (possibly including previously used parts that are as good as new in performance and reliability) product or part.
4.4 If VERYPOWER fails to repair or replace the defective product or part, VERYPOWER will refund the original buyer an amount calculated as follows:
If the product fails to comply with the limited performance warranty in Section 2.3, VERYPOWER may use the following refund formula to calculate the refund: refund = remaining usable capacity/guaranteed usable capacity x maximum claim amount;
*If the product is purchased new, free from defects, the maximum claim amount is the purchase price paid for the product by the original buyer of the product (or equivalent) as determined by VERYPOWER.
4.5 The above remedies are the sole and exclusive obligations of VERYPOWER to the original buyer under this limited warranty, and VERYPOWER will have no other liability to the original buyer if the product fails to comply with the limited warranty.
5. Claim Procedure
5.1 If the Original Buyer wishes to make a warranty claim under this Limited Warranty, the warranty claim must be reported in writing to the local distributor or VERYPOWER partner who supplied you with the product using the contact information specified below (if the Original Buyer is unable to contact them, the VERYPOWER Service Department specified below).

5.2 VERYPOWER or VERYPOWER partners will be authorized to charge and invoice for the inspection under any of the following circumstances:
5.2.1 VERYPOWER's or VERYPOWER's partner's inspection of the products shows that, for whatever reason, the limited warranty does not apply;
5.2.2 No defects have been found in the inspection process of the product, and the work is correct.
5.3 Unless otherwise agreed with VERYPOWER or VERYPOWER's partners, any replacement products or parts shall be returned to VERYPOWER or VERYPOWER's partners within 30 natural days of replacement in the same or similar packaging
5.4 Ownership of the replaced products or parts shall be vested in VERYPOWER
5.5 For any repair or replacement of the product, the original warranty period of the product shall still apply, that is, the warranty period of the repair or replacement parts shall be the remaining warranty period of the original purchased product.
6. Out of the warranty period
VERYPOWER may (at its sole discretion) provide certain after-sales services to the original Buyer if the product is out of warranty, but all costs such as parts, labor and travel shall be borne by the original Buyer. If such after-sales service is requested, the original buyer must provide sufficient information about all defects to enable VERYPOWER Partners to determine whether such defects can be fixed.
7. Appendix
7.1 Product Label Description
The production date of the product can be read from the serial number on the product label, as shown below. Battery modules and BCU have the same serial number definition for production date. In the example figure below, the underscore "19" indicates the year of production is 2019, "11" indicates the month of production is November, and "18" indicates the date of production is the 18th day of that month.
7.2 Testing Method of Remaining Available Capacity: Under the ambient temperature of 25℃±3℃
7.2.1 Charge the battery at 0.2C until the battery reaches the end of discharge voltage or its self-protection.
7.2.2 Stand the battery for 10 minutes.
7.2.3 Charge the battery with constant current and constant voltage until the cut-off current is reached.
Note: This document applies to all warranty policies of VERYPOWER Energy Storage products.
VERYPOWER reserves the right to interpret this document.
VERYPOWER may renew the above limited warranty. This warranty will automatically expire
when the warranty is updated.
